Won Election as Independents, Joined BJP Later: Tejashwi Seeks Disqualification of Two MLCs
Tejashwi Yadav seeks disqualification of independent Bihar MLCs Bansidhar Brajwasi & Dr. Rahul Raj under Anti-Defection Law after they joined BJP post-polls.
Two elected Bihar MLCs, who won the biennial elections in the Bihar Legislative Council (MLC) independently, joined Samrat Chawdhary-led Bharatiya Janata Party (BJP) unit in Bihar on Saturday evening. Following that, Rashtriya Janata Dal (RJD) Tejashwi Yadav has demanded that the two leaders be disqualified as the post-poll switch violates the anti-defection law under the Tenth Schedule of the Indian Constitution
On the evening of October 31, Bansidhar Brajwasi and Dr. Rahul Raj, the two independent leaders, went to the BJP office in Patna, took party membership, and posed photographs with membership slips. They were less than a week prior.
Why Did Tejashwi Yadav Demand Their Disqualification?
Tejashwi Yadav argues that such a move is illegal under India's Anti-Defection Law (Tenth Schedule of the Constitution). In the Rule for Independents, according to Paragraph 2(2) of the Tenth Schedule, if a candidate wins an election as an ‘Independent,’ they are completely barred from joining any political party after the election. If they do, they face automatic disqualification from the House membership, he says.
Tejashwi further stated that “under the provisions of Paragraph 6(1) of the Tenth Schedule, the authority to decide questions relating to the disqualification of a member on the grounds of defection lies with the Chairman of the relevant House.”
He also criticised the BJP for historically shielding defectors in the state, and has made a "mockery of the Constitution”.
#Bihar #RJD #TejashwiYadav

“A couple of years ago, several opposition MLAs had crossed over to the NDA, but the BJP Speaker did not cancel their membership despite written petitions by the respective parties. More recently, we have the example of Sahebganj MLA Raju Singh (BJP), who continues to be a member of the assembly despite having been convicted by a Delhi court long ago,” alleged the RJD leader , reported news agency PTI.
“Article 191(2) of the Constitution provides that a member disqualified under the Tenth Schedule shall cease to be eligible to remain a member of the State Legislature. Paragraph 6(1) of the Tenth Schedule vests the authority to decide questions of disqualification on the ground of defection in the Chairman of the Legislative Council,” he added.
The MLCs and the BJP Response
Once the controversy broke out, both the BJP and the MLCs tried to defend themselves. The BJP attempted to distance itself from the controversy by saying that Brajwasi and Raj, who were elected from the Tirhut Graduates and Saran Teachers constituencies respectively, had merely “extended support to the party”.
BJP spokesperson Kuntal Krishna and MLA Manoj Sharma issued video statements after the row emerged, stating that the two Independent MLCs were “extending their support, reposing trust in the leadership of Prime Minister Narendra Modi, Chief Minister Samrat Choudhary and JD(U) president Nitish Kumar”.
In the recently concluded biennial elections for eight legislative council seats, the BJP and JD(U) had fielded candidates in four seats each. The BJP won two seats, while JD(U) secured only one.
Raj, who recently resigned from the BJP, said: “I took that decision because of coalition compulsions. But I have always been a BJP worker with full faith in the chief minister’s leadership, and have taken the party membership again.”
He further claimed that “as per rules, an Independent MLC shall be deemed to be the party’s authorised candidate if he takes the membership within 15 days (of election)”.
Brajwasi said he decided to join the BJP after speaking with the chief minister, “who convinced me that I would be able to raise the issues of my constituency better upon joining the party”.
